Court summons Lagelu West LCDA Authority, others over disobedience of order

An Oyo State High Court has summoned the Lagelu West Local Council Development Authority and other defendants to appear before it for disobeying an order restraining them from the demolition of shops at Iwo road area of the state.

The case has been adjourned for further hearing till March 24, 2025.

The claimant, in a motion of ex-parte in suit no 1/252/2025 has sought the order of the court restraining the defendants, the Lagelu West Local Council Development Authority; Mrs. M.F. Oloyede; the Executive Governor, Oyo State and Commissioner of Police from carrying out demolition exercise as planned.

Counsel to the Claimants, Barrister Yomi Aliu, SAN, has sought the order of the court directing the Registrar to issue Form 48 endorsed with the enrollment of Order of Interim Injunction dated 28th February, 2025 against the 2nd Defendant and other principal officers.

He submitted that the 1st defendant has been duly served with the enrollment of interim order of injunction and in disobedience of the said order of interim injunction carried out their threat to demolish the shops built by the claimants.

Ruling on the ex-parte motion, Justice A.L Ladiran, ordered to cause Form 48 endorsed with the enrollment of the order of interim injunction issued by the Court dated 28th February, 2025 to issue for service on the 1st and 2nd Defendants and their Principal Officers listed on the motion ex-parte.

“In the meantime, however, the life of the interim order ex-parte earlier granted by this Court is further extended to remain extant till the next date of adjournment when the motion on notice for an order of interlocutory injunction will be coming up for hearing”, the judge said.
